PICKUP TIMES FOR THIS AUCTION WILL BE SATURDAY, AUGUST 2ND BETWEEN 9AM AND 2PM AND MONDAY, AUGUST 4TH BETWEEN 9AM AND 4PM. IF YOU NEED TO ARRANGE SHIPPING, PLEASE DO SO DURING SCHEDULED PICKUP TIMES. THERE IS NO GUARANTEE THAT YOUR ITEMS WILL BE AVAILABLE OUTSIDE OF THESE SCHEDULED PICKUP TIMES.
YOUR CHOSEN METHOD OF PAYMENT WILL BE CHARGED IMMEDIATELY FOLLOWING THE AUCTION. WE MUST HAVE PAYMENT BY THE END OF BUSINESS ON THE FOLLOWING BUSINESS DAY. ITEMS WILL BE ABANDONED IF PAYMENT IS NOT RECEIVED. NO EXCEPTIONS.

Sales Tax... Sales tax will be collected at each auction per state requirements depending on the state in which the auction is held. See terms and conditions for each individual auction to determine sales tax. If you carry a tax exempt status, you must submit and verify receipt of your tax exempt form to our office prior to auction end. Forms not received prior to auction end will be applied to future purchases however, tax will be collected for purchases prior to receipt of such form and you will need to apply to the state for a refund of the tax amount charged.
The bidding closes the first item at posted auction closing time, then closes 3 items per minute thereafter until the last item ends, in catalog order.
REMOVAL...This is an ONLINE ONLY AUCTION. Removal date is specified on auction page, please contact our office if you will require shipping or additional time to pick up your item(s). REGARDLESS of when the item is removed, payment for your invoice MUST be received the day after the auction ends. Additionally, a $20.00 per day, per invoice, late pick up fee will be assessed if items are not picked up by the 2nd day after the auction ends... NO EXCEPTIONS.
NO refunds or charge backs will be granted due to a lack of removal at the designated times. After the scheduled removal, items will be considered abandoned and you will be charged a removal fee of $50.00 to dispose of your item(s). Items will be considered abandoned IMMEDIATELY if payment is not received or we are unable to collect the late pick up fee by charging the credit card on file. If you require shipping please make arrangements as soon as possible after the auction ends if shipping is available on that auction.
BUYERS PREMIUM... A 15% buyer's premium will be added to each purchase. If you bid $100.00, at check out you will be charged $115.00.
PAYMENT... Accepted forms of payment include Visa, MasterCard, Discover, Cash, Certified Check, Money Order. If you are paying cash or cashiers check, please make arrangements prior to the auction close with our office at 205-620-3736. Otherwise the credit card you have chosen for each auction will be processed immediately following the auction close. We require payment within 24 hours of the auction close regardless of auction location, payment method, or shuttle times.
Registered bidders MUST have available funds on their credit cards to cover all items purchased. When registering for each auction, you will be asked to choose your method of payment. You will be able to add multiple credit cards, if desired, to choose from. If your credit card declines, you will be assessed a 2% fee for rerunning the card.
WAREHOUSE SHUTTLE & SHIPPING: Unless otherwise noted in the auction terms, we can ship items to you, so please make arrangements with our office on the listed auction pick up days. If you need additional days to pick up, let us know on pick up days and we will accommodate you if possible, but a $20 per day per invoice will be charged. If items are not picked up during the listed pick up days and we do not hear from you, your items will be considered abandoned. Pick up days are typically the two business days following the auction close. If the auction location is off-site, shipping may or may not be available. On some auctions we may be able to offer to shuttle your items to our warehouse for shipping or pick up, but you must make arrangements with our office prior to the auction close. Please note that shipping is not usually available on off-site auctions. Our base shuttle fee is $40 per pallet space (our standard pallet space is 40” x 48”). If any removal labor is involved outside of standard loading an additional charge will be applied to your invoice. If items are shuttled back to our warehouse storage guidelines still apply; see details under “removal” paragraph. For off-site location pick-up there will be a minimum $25.00 transport fee for any items that are not picked-up on the scheduled day.
Increasing your own bid / bidding errors... Please be aware that many bidders routinely increase their own bid to price an item out of reach of other bidders. You will be prompted to verify your bid before your bid is finalized. Once your bid has been submitted, it becomes a legally binding offer to purchase the item being auctioned. We will not reverse bids once submitted - NO exceptions.
Staggered Closing... Our online auctions generally close 3 items per minute (ex: items 1, 2 and 3 end at 7:00, items 4, 5 and 6 end at 7:01, and so on). This feature will close the bidding at intervals, which works great with the auto-extend feature to closely emulate a 'live' auction.
Dynamic Closing... The closing time of an item or lot is automatically extended to 3 minutes whenever a bid is placed within the last 3 minutes of the item's closing time.
Bid Notification... To quickly review your bids and see if you are winning or have won you can utilize the 'review bids' feature (found under "My Account"). Any items that you have been outbid on will be clearly marked.
Winning Bidder Notification... You will be contacted by email ONLY (you are responsible for checking your email). If you feel you have won an item yet have not received an email, you must notify us by email no later than 9:00 am the next day. At the time of pick up you will be asked to sign that all items have been received. Once the items leave the building, no adjustment or refund will be made.
IMPORTANT TAX EXEMPT STATUS... If you are tax exempt, prior to the conclusion of the online auction you must email a copy of your state's tax exempt form to firstname.lastname@example.org. (You must include your bidder number and the closing date of the auction). Forms without this information will not be accepted. If you have any questions call 205-620-3736.
CAUTION... For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions. Please go by descriptions when bidding on items. If part numbers are made available, we highly recommend that you research them to be sure that you are bidding on the item you think you are bidding on. Certain auctions may have manufacturers descriptions with stock pictures that may not portray the item correctly. (for example-the part number and description may be for a toilet tank only, but the stock picture may also show an entire toilet. Please be sure to research the part number listed in the description.
Catalog Inaccuracies... You are bidding on the described item, not the photo. Rarely does an error in photo insertion occur; however, always read the item description.
WARRANTY & CONDITION OF ITEMS SOLD... All items are sold "AS-IS, WHERE-IS", with NO WARRANTY expressed or implied by the lot number affixed to the item. Keep in mind that many of these items are restaurant worn and have been nailed to the wall in some cases. Descriptions are believed to be accurate but are not guaranteed. When you are not certain of the condition or use of an item please bid accordingly. We encourage you to preview items before bidding. You are bidding on the described item, not the photo. Bidders are responsible for their own removal. Any item NOT picked up by the allotted time will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Please ensure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location - no items will be released without a paid email receipt.
IMPORTANT!... The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchase, items not paid for and/or removed within the specific time. The buyer agrees to pay all deficiencies, legal, collection, transportation and late pick up expenses associated with delinquent accounts or abandoned items.
DAMAGE... Any damage caused by a buyer during the preview or removal must be made good by the buyer causing the damage. Buyer agrees that the credit card on file will be charged for any expenses and/or repairs to the pick-up location of property of another buyer. Items damaged by buyer during removal will not be refunded.
RELEASE OF LIABILITY... Sam Lilly Liquidators is not liable nor responsible for any bodily injuries, death to any persons or any damages to property when removing or transporting any items; your acceptance of these terms when bidding acknowledges this release of liability.
CHOOSE WISELY... We want every one to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly. The auctioneer reserves the right to add or remove items from the auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend, or reschedule an individual item and/or auction event, as well as make changes to the auction closing times or inspection or removal times.
Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Shelby County, Alabama. Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price only.
LIMITATIONS... The above-stated Conditions of Sale cannot be altered except in writing by The Auctioneer.
Registration Instructions...First, you need to register as a bidder to receive a bidder number to log onto our website. Additionally, you will be asked to register for each individual auction once and select your payment option for that auction. Go to the Registration Page and register as a new user.
